Branch Manager Liability – Governor Signs SB510

Existing Real Estate Law requires a real estate broker to obtain a license for each branch office and be liable for supervising the sales agents in that office. If the Department of Real Estate (DRE) requirements are not met, the designated broker risks license suspension or revocation. It is common practice for a broker to employ an office manager to supervise the operations of a branch office. Before passage of Senate Bill 510, a branch office manager did not share the designated broker’s responsibility for violating Real Estate Law if the real estate agents within the branch office were not properly supervised.

Under the new law, to be effective on July 1, 2012, the employing broker or corporate designated broker officer is permitted to contract with an eligible real estate broker or licensed salesperson (manager) to operate a branch office. The manager will be subject to disciplinary action for failure to properly supervise licensed activity of the sales agents and may have her/his license temporarily suspended or permanently revoked for failure to properly oversee and supervise operations of the branch office.

The new law includes the following requirements:

  •  The manager must:
    • Hold an unrestricted license,
    • Not be or have been subject to an order of debarment, and
    • If a salesperson, have at least 2 years full-time real estate experience within the preceding 5 years
  • There must be a written contract between the designated broker and the manager
  • The designated broker must give written notice to the DRE, in a form approved by the commissioner, identifying the manager and branch office or division
  • The designated broker must give immediate written notice to the DRE if the manager is changed or terminated

Senate Bill 510 was supported by the California Association of REALTORS®. The law was enacted to make office managers accountable if they fail to properly supervise their sales agents and is expected to ensure that consumers in California are afforded the best practices and highest quality of service from the real estate industry.

Designated brokers who have branch offices should review the qualifications of their branch managers and the provisions of their agreements and policies for compliance with the new requirements, and seek competent legal assistance to revise or create policies and employment contracts that meet the new legal requirements.

  • REBarCamp – REBarCamp is a free, day-long event at the San Jose McEnery Convention Center in which participants network and learn from each other in a free-forum format. Topics and sessions are not planned in advance and are borne of the attendees who choose to participate. This is a great opportunity for members who possess expert insight into some aspect of the real estate transaction, or who have found success in handling a niche issue in the real estate industry, to share their knowledge with colleagues. REGISTRATION INFORMATION

 

City of Corona SealThe Corona City Council adopted a revised Sign Ordinance. Originally, the proposed Ordinance had an absolute ban on all directional and Open House signs in the public right-of-way. Local governments may, at their discretion, ban virtually all signs, including commercial signs in the public right-of-way, which is consistent with the general public policy that permission be obtained from a landowner before any sign is placed on the landowners’ property. Since the City of Corona controls the public right-of-way for the benefit of the public within its City’s limits, it may completely ban all commercial signs within its right-of-way. The City of Corona compromised with the business community. The Ordinance, as approved by the City Council, continues to allow signs in the public right-of-way but under rigid restrictions. If the restrictions are not followed, the City may impose penalties and has the right to reconsider an absolute ban. Apparently, because of the activities of a few local offices who do not think the law applies to them, the City of Corona is reconsidering its Ordinance. Therefore, it is imperative that those persons who sell property in the City of Corona and who wish to place Open House or directional signs within the public right-of-way comply with the rules that have been passed. If we do not police ourselves, the City will take action!

The rules are relatively simple and are as follows:

  1. Temporary signs, (such as directional and real estate signs) may be permitted in the public rights-of-way only from 7:00p.m. Friday to 7:00p.m. Sunday.
  2. Signs left in the right-of-way before or after the approved period of time may be confiscated; and if the problem becomes habitual, the City Staff will advise the Planning Commission and City Council accordingly. Apparently, this has now occurred.
  3. Signs shall not be posted to create any safety or litter hazard and shall adhere to a specific criteria which is generally as follows:
    • Sign shall be 2 feet by 3 feet in size and no more than 3 feet high from the ground; and,
    • Sign shall be securely fashioned to ground on a single metal or wood support – not fixed to another sign, tree, structure, utility or mechanical equipment; and,
    • Sign shall be placed no closer than 10 feet from the comer to preserve drive site visibility. Signs shall not be placed within center median unless parking is provided adjacent to the median; and,
    • Sign shall be constructed of substantial sturdy material, not single layer cardboard, paper or bond stock; and,
    • Signs posted outside the criteria and/or times permitted will be subject to removal by the City with the costs to remove borne by the responsible party in accordance with Section 17. 74.200.

IT IS IMPERATIVE THAT REALTORS AND SELLERS COOPERATE WITH THE CITY OF CORONA SO THAT REALTORS MAY CONTINUE TO PROVIDE THIS BENEFIT FOR THEIR CLIENTS.
