The Senate's $8 billion tax cut package was attached to legislation increasing the minimum wage. The House package is expected to provide tax cuts of about $1 billion. Of interest to REALTORS® is a provision extending and expanding the deduction that permits owners of small businesses to deduct, rather than depreciate, the cost of up to $100,000 in new equipment. The provision would be expanded to a $125,000 allowance and would phase out when a business had $500,000 of income. Typically, in return for an agreement by the environmental group to not pursue a lawsuit based on one of the state's environmental protection acts, the builder agrees to the imposition of one or more PTTs through a covenant included in the covenants, conditions and restrictions (CC&Rs). PTTs have been as high as 1.75 percent of the purchase price of a home (for the median priced home this translates to almost $10,000…¦a significant amount of money): every buyer of a home in the development for 20 to 25 years or, even, in perpetuity must pay these "taxes." In October, 2006, the California Association of REALTORS® Board of Directors adopted the final report of the PTTs Task Force. In that report, it recommended the following:<br /><br /><strong>"That C.A.R. sponsor legislation to prohibit the imposition of a PTT."</strong><br /><br />In January, 2007, the California Association of REALTORS® Board of Directors, in addressing <strong><u>existing</u></strong> PTTs, made the following motion:<br /><br /><strong>"That C.A.R. sponsor legislation to require a separate seller disclosure to potential home buyers as to whether the home they are considering purchasing requires the payment of a Private Transfer Tax (PTT), the percentage of the home price constituting the PTT (possibly with dollar amount examples), and/or the duration of the PTT, and that it may potentially affect the future resale value of the property."</strong><br />Please stay tuned for more details about these two important C.A.R. Pending Home Sales Rise

The index, based on contracts signed in December, rose 4.9 percent to an index of 112.4 from an upwardly revised level of 107.2 in November, but is 4.4 percent lower than December 2005. The monthly gain was the biggest increase since March 2004 when the index rose 6.9 percent. "Some of the monthly gain may be weather related, but it appears buyers are becoming more comfortable, sensing the timing is good and that their local market has bottomed out," says NAR Chief Economist David Lereah. "I expect modest sales gains throughout the year, with what I believe are sustainable levels of activity. 2007 promises to be the fourth best year on record." </td></tr></tbody></table>
Senate Small Business Tax Package Passes

The tax package includes an extension of the 15-year leasehold improvements provision through March 31, 2008, and an extension of the $100,000 expensing rules through 2010. The House has neither considered nor passed a similar tax package, although it did pass the minimum wage increase. Ways and Means Committee Chairman Charles Rangel (D-N.Y.) does not support enactment of a tax package at this time. Accordingly, there is presently no plan to take the legislation (H.R. 2) to conference. Thus, the timing for enactment of the minimum wage increase is also uncertain. </td></tr></tbody></table>

The guidance, which grew out of a Civil Rights executive order issued in 2000, applies to entities that receive federal financial assistance. In housing, this could include projects that receive rental assistance or construction subsidy, among other assistance. It does not apply to FHA insurance but would apply if the FHA insurance was coupled with a federal rental or construction subsidy or other federal assistance. NAR Urges Congress to Develop Disaster Coordination System
